How Christian Conciliation Agreements Can Help Your Religious Organization Stay Healthy and Out of Court!
Faith-based organizations are not immune to disputes. Nor are they immune to lawsuits brought from within and without the organization. Christian Conciliation is a faith-based process for resolving conflicts through biblically grounded coaching, mediation, and/or arbitration.
In 1 Corinthians 6:1-7, Paul admonishes believers to resolve disputes amongst themselves, with the help of someone in the church “wise enough to judge” the dispute. This stands in

stark contrast to Christians taking other Christians to court “in front of unbelievers.” 1 Cor. 6:6. Additionally, faith-based nonprofits are usually driven by a God-given desire to maintain and restore peace (see “Biblical Peacemaking in the Nonprofit Sector: Building Peace Through Purpose” by WJRB attorney Bill Ratliff).
So, what if your organization had agreements, signed by directors, officers, employees, independent contractors, and volunteers, that required disputes to be settled using Christian, Biblically-based mediation (and, if necessary, arbitration) rather than by filing lawsuits in state or federal court? Such agreements are enforceable, if drafted and executed properly, and can be incredibly powerful to prevent lawsuits, resolve disputes before they escalate to the point of litigation, ensure that disputes are adjudicated biblically, and even bring about reconciliation among the parties.
All Christian churches, ministries, nonprofits, and organizations should consider incorporating Christian mediation/arbitration provisions in their constitutions, bylaws, employment agreements, employment handbooks, and even in their contracts with third parties. By doing so, the organization is not only taking a step toward honoring God’s word, but also making a commitment to honor its relationships with those in its community.
Christian conciliation agreements are generally enforceable, but there are legal nuances and exceptions that should be carefully navigated with experienced counsel.
